A nurse is suing a Pennsylvania nursing home, citing alleged disability discrimination, retaliation, and wrongful discharge. According to the complaint, she was suspended until investigations into two alleged incidents were completed, one in which a bottle of medication was mislabeled, and a second in which she was accused of failing to follow policy. The plaintiff alleges that she was singled out for suspension because she had requested an accommodation for her disability of osteoarthritis in her knees and disc disease of the lumbar spine, as she had trouble standing for extended periods of time. She claims the nursing home terminated her because of the accommodations that she requested, using the pretextual reason of “failure to follow policy,” despite the plaintiff having no knowledge of policy, either because it did not exist, or because it was not enforced.
